PIVOTAL RESEARCH LTD (“Pivotal”) PROVIDES THE ADMINISTRATION PLATFORM FOR THE SERVICES YOU PARTICIPATE IN. WE ARE NOT A BROKER, FINANCIAL INSTITUTION OR CREDITOR.

By participating in any of Pivotal’s Services, rewards program, or otherwise accessing or using the Pivotal’s UI, App, website, you accept and agree to be bound and comply with these terms and conditions, and those set forth in our Terms of Service:

• Points are not convertible, accruable, useable as a basis to calculate, or become, any tokens or other digital assets or distribution thereof.
• Points are virtual items with no monetary value.
• Points do not constitute any currency or property of any type and are not redeemable, refundable, or eligible for any fiat or virtual currency or anything else of value. You acknowledge that Pivotal is under no obligation to generate tokens.
• Points are strictly non-transferable, and you may not attempt to sell, trade, or transfer any points, or obtain any manner of credit using any points.
• Any attempt to sell, trade, or transfer any points or token redeemable for or representing any point will be null and void, unless otherwise expressly stated or updated in writing.
• Pivotal reserves the right to suspend, cancel, modify, discontinue, limit or withdraw this points program (including the eligibility, criteria, calculation or mechanism for earning such points), at any time with or without notice and regardless of any particular accumulation of points.
• You agree not to engage in any fraudulent, dishonest, manipulative or abusive activities (including without limitation, wash trading, create multiple accounts to claim additional points or digital assets, using bots or scripts to automate claiming, or participating in any schemes that artificially inflate the number or perceived value of points or digital assets) in connection with points or any distribution of digital assets by us and/or our affiliates.
• Pivotal reserves the right to forfeit and terminate any or all of your points if you breach any terms and conditions hereunder or license granted by us. The reasons for such action may be disclosed privately and/or publicly.
• Staking of points is strictly prohibited.
• Points are not available to persons who are citizens of, residents of, green card holders of, incorporated in, owned or controlled by a person or entity in, located in, or has a registered office or principal place of business in the United States (defined as a “U.S. person”). This extends to persons who are acting for the account or benefit of any U.S. person; persons in any jurisdiction in which the offer, sale, holding, and/or purchase of digital assets or cryptocurrencies is unlawful, prohibited, or unauthorized (together with U.S. persons, a Restricted Person”); or persons subject to sanctions or who are resident or nationals of a sanctioned jurisdiction.
• Users from the territory of UK are advised that protections provided by the UK regulatory system in connection with cryptoassets will not apply, as Pivotal is not authorised or regulated by the UK Financial Conduct Authority (FCA). If you are a UK Resident, the terms in the UK Resident shall apply.
